[theme-reviewers] Premium theme update notification?

I'm developing some premium WordPress themes (Non GPL license).
I have some question and hope anyone can reply for me:
- Can we use WordPress theme update notification features?
- Can we use WordPress Trunk for premium themes?

I know these questions are not follow the criteria of Theme Reviewers Group
But I want to find answers from real people with experience
