Let's simplify this whole matter.
Based on the Theme Review Guidelines: "Author URI, if used, is
*required*to link to an author's personal web site or
project/development website. "
Now, given if the theme meets all other required guidelines, the theme
should be resolved to an approved status.
The Author URI guidelines, nor any of the Credit Links guidelines (
http://codex.wordpress.org/Theme_Review#Credit_Links) does not state
anything at all about the actual domain name, period. Whatever the domain
is, or was used for in the past, should not be relevant to the theme's
approval resolution ... obviously I would expect there may be exceptions,
such as for profane / vulgar domain names but this is not the case.
