Guess you should go through the repo and find all those themes that are “based off of twentyten(eleven/twelve)” now too ... since they are exactly your description: "John Doe just cannot download the Theme, do some improvements, change the name and re-release it. “

If Jane Doe releases a Theme and gets included in WPORG, John Doe just cannot download the Theme, do some improvements, change the name and re-release it.
This would probably be all right if PageLines gives John Doe full blessing.

!This theme hasn't been updated in over 2 years. It may no longer be maintained or supported and may have compatibility issues when used with more recent versions of WordPress.
