This is a good thinking. I don't believe themes available in the
public theme directory must be required to have comments.php (or,
commenting functionality), because in some cases it could cause a
conflict to a design decision. If a theme, by a visual design
consideration is not allowing comments, then it should not be required
to append a comments.php file.

In any case, I still believe a minimum comment functionality should be
packed in case the user wants to enable commenting features. I think
it's better to recommend theme developers to append a comments.php
just in case.
