Comment:

 This is (looks like) an architectural decision in TinyMCE. It can only be
 fixed/changed upstream. In that terms it is "working as expected" in WP.
 Furthermore it is now superseded by the block editor. The blocks use
 either `<p>` or <div>` as appropriate.
