Comment:

 Who decided to revert this fix? Could you please post the reasoning here?

 In 4.9.6 this was "forced" on by default without being needed (lawfully).
 If the option to disable it is removed, I think we should remove the
 actual "comment consent" checkbox too.

 I'd consider this fix a blocker for 4.9.8.
