 We're running PHP 5.4.15

 Not sure what to say about your default WordPress comment. The only way
 that code is executed is via your own:

 add_filter( 'wp_handle_upload_prefilter', 'check_upload_size' );

 So, if you don't intend to handle other cases, then WP should not run it
 in an observable?
