Comment:

 The initial description is incorrect, none of the current or former
 default themes produce invalid markup.

 As a theme developer I was surprised to see that themes apparently have to
 use a <div id="content"> for content, and that they can't put that <div>
 into header.php. I'll look into updating the codex.
