 See... here's the problem with the "trademark" argument:

 I might write in my blog: "Slap a band-aid on it."  Yes, that is incorrect
 use of the Band-Aid brand, but despite the fact that their lawyers would
 much prefer me to write "Slap a Band-Aid™ Brand Adhesive Bandage on
 it", it is my blog and my writing, not Johnson & Johnson's.  It's simply
 not their decision to make.
