 Alright, enough. Matt is aware of this concern. He's the author of the
 plugin, and the director of the WordPress Foundation, and he has lawyers
 he can contact if he wishes to get a legal opinion.

 Fair use is a subjective matter in the United States. We're not going to
 convince each other of our personal, subjective judgements. I know it's
 fun to warm up our search engine skills and play lawyer for a day (I'm as
 guilty as anyone of that), but this is not the right place to do it. Your
 concerns have been heard, and noted. There are more productive ways to
 continue contributing to WordPress.
