 True. I was thinking about this usecase:

 1. User edits a post with no images in the gallery (the url is
 &tab=upload)

 2. User adds an image to the gallery and then closes the box

 3. User clicks the Add Image button again (the url will still be
 &tab=upload)

 You would have to change the URL through JS just after the first image is
 added to the gallery.
