Comment:

 I am -1 on this patch as it stands.

 I can't see a reason why moving that line of code fixes a bug.

 A plugin that the reporter is using must surely be dieing inside the
 publish_post action in order for the lines of code afterwards to not be
 called.

 Fixing the plugin is the correct thing to do in this situations.

 sweetdeal can you please provide example code which shows the issue and a
 list of other plugins you have installed.
