 It is not legal.

 Under GPDR and the ePrivacy Directive it is NOT legal to load any data
 from accessing the users device without explicit and informed consent.

 There is no valid argument that it should be legal under GDPR, it does not
 exist and there is no reason for loading Google Tag Manager at all or any
 other 3rd party until an informed and explicit consent has been given by
 the user.
