 I would see this more as a flagging system thing, so if a user consider
 that a particular theme is trying to much to upsell it should be able to
 flag it.

 Excluding all themes who are doing an upsell is not really making sense,
 since a theme where 2-3 optional things are in a pro version might be much
 better than a theme that has no pro version.

 Also what about people who try to upsell plugins, customization
 work,support or collect emails ? Is quite rare to see a totally free, pro-
 bono and great product.

 The issue looks complex, so leaving a way for users to give feedback is
 the best option from my point of view.
