themes.wordpress.net has it's share too.
I used to make noises in the forums when I found hidden links in
footers, hidden adsense blocks and such but then some theme authors ...
made a financial decision and some crap businesses knocked a few themes
together for SEO.
Average user look in the footer? No - why would they?

Exploitation?
Fair business use?
Reward for days of toil and sweat over the burning CSS?

It's a scam.
