[theme-reviewers] Can we use Justin Tadlock's pagination in a theme?

It's more of a personal question, as well as for future references.
Justin Tadlock uses a custom pagination script in his every WP.org
theme and never had an issue with it.

But I was told on this ticket that we aren't allowed to have a custom
pagination script in .ORG themes:
