[theme-reviewers] A couple of doubts about the "Make" theme and what's allowed

There are two little things about the "Make" theme that I'm not sure if
they are allowed.

Can anybody please tell me if I'm wrong? I just want to learn, so I can do
better reviews. :)

*1. In the customizer there are several upgrade links. I thought they were
only allowed on the Theme Options Page.*

*2. You can also add some arbitrary text on the header and footer. Isn't
that plugin territory, since it's creating content?*
