[theme-reviewers] Providing commercial non-GPL themes

Ok.. So font pack is not GPL compatible.
Somehow i want to give my commerical users to use this font-pack.

If i split it from theme and create a plugin that includes font-pack and
makes statement that they cant reproduce or resell this plugin.
Is it again violating commerical theme rules?
