Yes, but you're missing a finer point.

It's always been WP policy that everything needs to be 100% GPL, not part
GPL, part proprietary.

So, the fact that someone can remove the proprietary API code is a moot
point, it's not allowed to exist in the code in the first place. See the
difference?
