[theme-reviewers] License question

Hello!

I'm reviewing a theme (http://themes.trac.wordpress.org/ticket/15760), that
is based on free css template available here:
http://www.templatemo.com/preview/templatemo_366_agency
It says that those free css templates are licensed under CC Attribution 3.0
License. Can such theme be accepted to the repository?
