This is definitely unique Theme Options and as far as the image itself, IMO
it's acceptable (if the image is GPL-Compatible that is).

However the only option in Theme Option is (Customize Background) that's
about it, the rest is up-sell feature and I will leave that up to your
judgment.

*Please note that Themes cannot require users to upgrade to remove author's
credits, this is something I've noticed, but didn't check everything behind
the codes (5:27AM will do that)*
