No, we cannot refuse the name!

If the name is available and not against the Theme Name
guidelines<http://codex.wordpress.org/Theme_Review#Theme_Name>

it should be accepted. We don't "police" Commercial Theme Names.

"Warez etc" prohibited maybe, right to ask and include? Most definitely :)
