[theme-reviewers] Themes based on other themes

[Central Victorian Irish Association]

Good morning/evening/afternoon/night/chtistmas etc.
Just a question.
I am reviewing a theme at the moment that is evidently based on TwentyTen and I have run it through the Theme Check. Everything seems fine except it indicates on every single file that TwentyTen Text Domain is being used.
Is this allowed or should it be declined on this? I am under the impression that if a theme is based on TwentyTen, or any theme at that, that it is no longer TwentyTen and should contain no mention of it. 
Your feedback oh great masters of WordPressing is appreciated.
