A couple things:

1) Please start your own topic, rather than reply to digest emails.
Replying to digest emails makes it harder to follow conversations.
2) Please post ticket-specific questions directly in the ticket *first*.
You're welcome to ask for a second opinion in the ticket, and the reviewer
will follow up  on your questions.

As for your specific issue below: per the current guidelines, Themes are
REQUIRED to replace TEMPLATEPATH with get_template_directory().
