Good question; as far as I know, as long as the developer only offers Themes
that are fully compliant with the WordPress license, and the submitted Theme
is 100% GPL, then there should be no problems.

The official WPORG position is that split-license, with all PHP being
released as GPL-compatible, *is* compliant with the WordPress license.
