http://www.apache.org/licenses/LICENSE-2.0.html and http://scripts.sil.org/OFL and copy of the license would not apply if the actual font is not stored in Theme, correct? Since it's hosted and located on Google server.

He needs to include a version of the GPL compatible license as a .txt file with the fonts bundled in his theme.

Christian, not really, this what you sent is the general TOS of Google accounts and I am afraid they have very little or nothing to do with their Fonts. Once again:
Google Fonts are released under Apache License, version 2.0 and/org SIL Open Font License, 1.1, both are equivalent to GPL and there for a reason. There's no dual license when it comes to things like that, it's either "open-source" or not :) So Syahir yes you can. Period.

Also you should read the TOS for "the Service" Google code, obviously if you want to stay informed ;).
"The fonts in the directory are all released under open source licenses; you can use them on any non-commercial or commercial project."
I am using two of these fonts in my themes, the only issue being that in some cases the font is not rendered correctly, but this is not related with this subject.

Hey, look: it's a licensing issue that Otto and I agree on! ;)

A link to Google's servers for using fonts that aren't actually
included in the theme does not incur any license issues, and I'll kill
any man who says differently!
Or at least disagree with them vehemently... Maybe. ;)
