Every theme that based on TwentyTen should have no problem passing
Theme review in terms of code base. The only problem is that most of
it doesn't edit or alter any reference that mention TwentyTen (PHPDoc,
Text Domain and so on.)

The possibility of TwentyTen exist in every WordPress 3.0 installation
is probaby 99.9%. Comparing using diff, this could be submitted as a
Child Theme.
