[theme-reviewers] question about first theme review (in progress)

The theme I am reviewing has re-used many of the Twenty Ten theme template
files.  I assume this is okay because it's GPL2, but my real question is,
should the header at the top of the template file keep the Twenty Ten
attributes or should the theme author change it to reflect their own?
