For posts with no title, would the comments link count, instead of i.e.
making the date the permalink?

(no title) 

*	Post displays properly. 
*	A link to the singular view of the post is recommended to be
displayed. Making the post date a permalink (see Twenty Ten for an example)
is a great solution.

I generally only use validation if the theme appears "visually" broken, then
the validator can help point out where the issue might be found. Otherwise,
as Otto says, take it with a grain of salt.

It would be an extremely rare care where I would "not-approve" a theme over
a validation issue.
