[bbDev] search result error

Hate to report this, but i updated everything, dif's and all. and i 
still get redirected to the parent WP install's 404.php.

notes:
Mod ReWrite is OFF in bbPress
No mention of 404.php in the root htaccess file.
No htaccess file in the bbPress directory

I am curious to know if anyone else is having this trouble.
