 Option 4, with some refactoring of the modal top part:
 - heading and button stacked vertically
 - visual order and DOM order match: heading > button > menu
 - the heading doesn't necessarily needs to be "big"
 - of course the font sizes can be adjusted and some more white space
 added: this is just a quick in-browser editing to illustrate the idea
