 Simply, repeatedly, stating that its a violation doesn't make it so.

 Conversely, stating that it is not a violation does not make it so.

 If you think this is fair use, please cite an objective, reliable source
 to support your viewpoint. The sources cited in comment 9 above make it
 clear that this cannot possibly be fair use.
