 @nacin: It is not clear whether you think we should commit the .2. patch
 or you are referring to the queries in the comment from technosailor.

 Not sure why the third query checks post_status = 'spam' either?

 I think checking for comment_status != 'spam' is the best fix but it needs
 some explain'ing to check.
