 Changing the permissions on the folder are what you need to do.

 If changing the permissions do not work, Then its a server configuration
 which WordPress cannot work with.

 chmod /uploads/ /uploads/2009/ and /uploads/2009/01 to 0777 and try again,
 create /2009/ and /2009/01 if they do not exist first.
