Matt,
I think Chris's point was that doing a filter there would be useful once the
theme is already activated. But that's exactly what we're trying to avoid.

The point is that we need a way making a theme hidden just by adding a
parameter to the style.css file.

Having to use the theme's code in order to hide the theme from the theme
list makes no sense.  It would never work.
