Another tack that occurred to me:
Distribute the theme sans icons and state that anyone wishing to get
the "full" effect download the (separately-licensed) add-on pack and
just drop it into the images/mini2 sub-directory or somesuch.

That would likely hamper adoption of the theme, but at least the
licenses would be clean.  I'll contact the artist/author and see what
he thinks of a relicense/dual license scenario.
