<div>I've always found the Nivo Slider licensing to be confusing, and recieved no response from the developer when I asked for clarification.</div><div><br></div><div>Yes, the basic jQuery plugin is MIT (which I'm assuming is what's being used in the theme?). But their WordPress plugin is listed on the licensing page as GPLv3, while <a href="http://nivo.dev7studios.com/pricing/">their pricing page</a> says the WordPress plugin is limited to one site and not permitted for use with premium plugins (obviously not GPLv3 compatible terms).</div>
