Die Zwangsvollstreckung gilt als erfolglos, wenn entweder der
Gerichtsvollzieher
kein Bargeld oder pfändbare bzw! pfändungswürdige Gegenstände beim
Schuldner
gefunden hat oder zweimal keinen Einlass in die Wohnung des Schuldners
bekommen
hat (davon mindestens einmal nach vorheriger schriftlicher Ankündigung)
oder der
Schuldner der Wohnungsdurchsuchung zur Auffindung pfändbarer Gegenstände
widersprochen hat. Der zu vollstreckende Betrag wird dem
Gerichtsvollzieher vom
Gläubiger zuvor jeweils formlos mitgeteilt und kann den tatsächlichen
Anspruch
um ein Vielfaches übersteigen. Dies stellt jedoch – ebenso wie der
Nachweis,
dass die Zahlung geleistet wurde – keinen ausreichenden Grund dar,
sich der
Vollstreckung bzw. Abgabe einer EV zu verweigern.</p>

die bei glaubwürdiger Argumentation zur vorläufigen Einstellung der
Vollstreckung (der Betrag muss dann allerdings ggf. an die Gerichtskasse
geleistet werden, ebenso ein Kostenvorschuß) und Aufhebung des bereits
erlassenen Haftbefehls führt. Dennoch muss der Betroffene (auch wenn
der Eintrag
zu Unrecht erfolgte) noch monatelang mit Vertragsablehnungen rechnen, da
das
Schuldnerverzeichnis von zahlreichen Auskunftsdiensten übernommen und nur
in
gewissen zeitlichen Abständen aktualisiert wird!</p>

Tatsächlich werden Haftbefehle zur Erzwingung der Abgabe der
eidesstattlichen
Versicherung nur sehr selten vollstreckt. Vielmehr steht es dem
Gläubiger frei,
ob er den Gerichtsvollzieher erneut damit beauftragt, dem Schuldner die
eidesstattliche Versicherung abzunehmen, wobei der Gläubiger hierfür
regelmäßig
einen Kostenvorschuss zahlen muss. Wenn der Schuldner der Aufforderung
erneut
nicht Folge leistet, darf der Gerichtsvollzieher ihn verhaften und in
eine
Haftanstalt bringen, sofern der Schuldner nicht zuvor doch die
eidesstattliche
Versicherung abgibt. In der Praxis genügt regelmäßig die Drohung des
Gerichtsvollziehers mit der Verhaftung, um den Schuldner zu veranlassen
(zumeist
direkt in seiner Wohnung) die eidesstattliche Versicherung vor dem
Gerichtsvollzieher abzugeben. Der Haftbefehl zur Erzwingung der Abgabe
der
eidesstattlichen Versicherung wird in das <a
