[theme-reviewers] Theme preview

I created a theme Gold <http://wordpress.org/themes/gold> for wordress.org.
The menu gets activated once the user creates it in the admin. This creates
a problem in the the theme preview in wordpress.org. Also the home.php is
not displayed at front. Is this normal? Aren't we allowed to choose our
theme preview?
