[theme-reviewers] "FancyBox".. Allowed?

Cause last time I checked, it wasn't (in a theme reviewer list email).

Now that it comes with Creative Commons Attribution-NonCommercial 3.0
license, I am only restricted to use it on commercial templates.

If it's still not allowed, can I purchase the Multi-Domain license and use
it on WordPress Repo Themes?
