Yes, that's fine (though technically, it's *split* licensing, not
*dual*licensing). Split licensing satisfies the WPORG policy that
Theme PHP code
inherits the WordPress GPL.

WPORG-hosted Themes have to be 100% GPL-compatible, as a matter of WPORG
policy, not as a matter of license requirements.

Is that license.txt available anywhere publicly, for future reference?
